QATAR EXECUTIVE GENERAL CONDITIONS FOR AMPHIBIAN (CESSNA CARAVAN) CARRIAGE FOR FLIGHTS BOOKED THROUGH DISCOVER QATAR

 

1. INTRODUCTION

1.1     In these Conditions, capitalized words and terms used in these Conditions shall have the meanings set out as below:

 

Qatar Executive                means Qatar Executive W.L.L and shall, save where the context otherwise requires, include its officers, servants, employees, agents, and subcontractors.

 

Discover Qatar                  means Discover Qatar W.L.L and shall, save where the context otherwise requires, include its officers, servants, employees, agents, and subcontractors.

 

Passenger/s                      means any person/s (except members of crew) travelling on Qatar Executive Amphibian flight on a valid Booking Confirmation who may in these Conditions of Carriage be sometimes referred to as “You” “you” or “Your”.

 

Baggage                            means the Passenger’s personal property accompanying the Passenger in the journey taken on board the aircraft and accepted by Qatar Executive.

 

Carriage                            means the transportation of Passengers and Baggage provided under the contract of carriage as evidenced by the Booking Confirmation issued to the Passenger.

 

Conditions of Carriage     means those statements contained in or delivered with any Booking Confirmation issued including inter alia these terms, conditions and notices, which are hereby incorporated by reference into all Booking Confirmations issued for travel on Qatar Executive Amphibians, available at the office(s) or on the website of Discover Qatar at https://www.discoverqatar.qa.

 

Booking Confirmation      means a document or documents issued by or on behalf of Qatar Executive to Passengers that contains the Passengers name, flight information and notices and includes these Conditions of Carriage which shall form part and parcel of the contract of Carriage between the Passenger and Qatar Executive.

 

1.2.    These Conditions of Carriage shall apply to the Carriage by Passengers and in relation to any liability Qatar Executive may have in relation to that Carriage and transportation.

1.3.    Terms & Conditions Prevail - Except as provided in these Conditions of Carriage, in the event of inconsistency between these Conditions of Carriage and any other regulations we may have dealing with particular subjects, these Terms & Conditions shall prevail.

1.4.    Overriding Law – These Terms and Conditions shall be subject to applicable legal and regulatory requirements from time to time. In the event any provision of these Conditions of Carriage are adjudged or deemed to be illegal, invalid, void and or unenforceable, the remaining provisions of these Conditions of Carriage shall not in any way be affected or impaired but shall remain binding to such extent as permitted by applicable law.

2.  Flight Booking Confirmation       

2.1.    Booking Confirmations shall only be valid for the date, destination and Passenger specified thereon.

2.2     All Booking Confirmations can be cancelled by the Passenger free of charge up to 72 hours before the service date. Booking Confirmation amendments or changes can be made free of charge up to 72 hours before the service date (subject to availability).

2.3     The Booking Confirmation shall constitute prima facie evidence of the contract of Carriage between the Passenger and Qatar Executive.

2.4     Qatar Executive will provide Carriage only to the Passenger named in the Booking Confirmation. The Passenger will therefore be required to produce appropriate identification at check-in.

3.  Fares             

3.1       All fares, flight schedules and routes published are correct at the time of publication. Qatar Executive, and Discover Qatar on behalf of Qatar Executive, is entitled and reserves the right to revise any fares and flight schedules at any time and from time to time without prior notice.

3.2       An infant who is between the ages fifteen (15) days old to two (02) years will be allocated the same seat as the parent/guardian over eighteen (18) years of age free of charge. Regrettably we are unable to accommodate Infants within fifteen days of birth for Carriage for health and safety reasons.

3.3       Fares apply only for Carriage from the airport/dock at the point of origin to the airport/dock at the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airports/terminals/docks and hotels.

3.4       Fares must be paid in full when a booking is made. In the event that the fare has not been paid in full when a booking is confirmed for any reason whatsoever, Qatar Executive reserves the right to cancel the booking prior to check-in and/or to disallow the Passenger to board the aircraft.

3.5       The Passenger hereby acknowledges and agrees that personal data are provided to Qatar Executive for the purposes of making bookings for Carriage and to provide the Passenger with confirmation of that booking, providing and developing ancillary services and facilities, accounting, billing and auditing, checking credit or other payment cards, security, administrative and legal purposes, statistical analysis and to facilitate any future dealings with Passenger. For these purposes, by entering into a contract of Carriage with Qatar Executive, whether directly or through the intermediacy of Discover Qatar, the Passenger authorizes Qatar Executive to process, retain and use personal data and to transmit the same to its own offices, authorized agents and third-party business associates, government agencies, other carriers or the providers of the services mentioned above. Passengers’ personal data will be processed by Qatar Executive in accordance with the applicable law and regulations on the processing of personal data and the Qatar Executive privacy notice, available here and on the privacy notice page of Qatar Executive’s website. Passengers may exercise their right to object to the collection and use of personal data, but this may result in cancellation of the Carriage. Should the Passenger wish to access, rectify, or erase personal data or object to the use of personal data provided to Qatar Executive pursuant to these Conditions of Carriage, please refer to the Contact Us page of Qatar Executive.

3.6       Applicable taxes, fees and charges imposed by government or other authority, or by the operator of an airport, shall be payable by the Passenger. At the time the Passenger makes the booking, all known taxes, fees and charges are included. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Booking Confirmation. If there is an increase in a tax, fee or charge shown on the booking, the Passenger will be obliged to pay it. Likewise, if a new tax, fee or charge is imposed even after receiving Booking Confirmation, the Passengers shall be obliged to pay it. Whilst there will otherwise be no increase in the price of the booking after it is confirmed and paid for, Qatar Executive reserves the right to impose a surcharge to reflect increased costs resulting from any exceptional event or circumstances, which Qatar Executive, or Discover Qatar on its behalf, will communicate and the Passenger is obliged to pay.

4. Check-In, Boarding and Conduct

4.1.      Check in will be 30 minutes prior to the scheduled departure time. The Passenger is responsible for ensuring that all travel documents including a valid Booking Confirmation and passport and/or Identity Card required to identify the Passenger are available at the time of check in.

4.2.      Qatar Executive reserves the right to refuse Carriage or to refuse to check in a Passenger, without any liability to such Passenger and without having to refund any fare paid, in the following circumstances:

4.2.1. if the Passenger reports or attempts to check in at any time where less than thirty (30) minutes remain to the scheduled departure time of the flight;

4.2.2. if the Passenger has not fully paid any fare or other fees or charges due to Discover Qatar on behalf of Qatar Executive;

4.2.3. if the Passenger has been violent to the staff of Qatar Executive or caused disturbance at the counter or abused Qatar Executive staff whether physically or verbally; and/or

4.2.4. if in the judgment of Qatar Executive, the Passenger is not fit to travel due to drunkenness or any obvious adverse medical condition or poses or could pose a danger or threat to the health and safety of other Passengers, the Aircraft or its operations.

4.3.      Failure to produce the necessary documents may result in Qatar Executive refusing to permit the Passenger to board the aircraft, forfeiting the Passenger’s seat. Qatar Executive and Discover Qatar shall be under no liability whatsoever to the Passenger in respect of such forfeiture and refusal to board the aircraft as aforesaid.

4.4.      There are no seat allocations according to specific seat numbers. Qatar Executive operates a single-class and free-seating policy. Priority for boarding is given to the handicapped, elderly and those travelling with children;

4.5.      The Passenger shall not enter or stay in the aircraft in any event wherein the opinion of any servant or agent of Qatar Executive, his/her mental status or physical condition or general behaviour is objectionable to other passengers or staff, or it involves him/her being a hazard to himself/herself, other persons or property or render a Passenger incapable of caring for themselves and Qatar Executive and Discover Qatar shall not be liable or responsible to provide substituted Carriage for such a person, any refund or other associated costs.

4.6.      The Passenger shall remain seated at all times during the flight.

4.7.      The Passenger shall not smoke in or in the vicinity of the aircraft, throw anything from the aircraft or walk in or about in front of the aircraft or in the vicinity of the engine and propeller at any point.

4.8.      The Passenger shall not, whilst on board the aircraft, consume any intoxicating beverage.

4.9.      If the Passenger fails to check in on time or fails to board the aircraft by the time the aircraft departs, the fare paid by the Passenger will not be refunded for any reason whatsoever.

4.10.    The Passenger shall submit to any security or health checks by State of Qatar or airport officials or as required by Qatar Executive.

5. Refusal and Limitation of Carriage

5.1.      Passengers acknowledge that those with special needs (except for accompanied minors) cannot be accommodated under usual circumstances due to the inability to provide adequate facilities at all locations. Passengers with special needs are required to contact Discover Qatar for confirmation of acceptance prior to making a booking.

5.2.      Passengers acknowledge that the aircraft operated by Qatar Executive is unpressurised and that Qatar Executive cannot accommodate Passenger’s with altitude-related health problems. The Passenger shall be responsible for disclosing any such health-related problems before boarding, which will require medical clearance in writing from their doctor in order to travel.

5.3.      Expectant mothers shall require medical clearance from their doctor in order to travel, which shall be evidenced by a doctor’s certificate, obtained not more than one week prior to travel, confirming fitness to travel and stating the following compulsory information: 1. Duration of the pregnancy, 2. Expected delivery date (EDD), 3. Blood pressure.

5.4.      Qatar Executive regrets that it is unable to accommodate any Unaccompanied Minor/s (UM) for Carriage for safety reasons.

5.5.      The Passenger hereby acknowledges that all services of Qatar Executive are entirely at the Passengers own risk. Qatar Executive and Discover Qatar shall not be responsible for any direct/indirect losses arising from and including, but not limited to, pregnancy, travel sickness, altitude health-related problems and any undisclosed health condition inherent to the Passenger.

5.6       Limit of physical weight of the Passenger for Qatar Executive amphibian carriage shall be less than 110 kg. Any Passenger who exceeds 110 kg of physical weight is required to notify Discover Qatar at the time of booking. In case, any Passenger fails to so notify, Qatar Executive has the right to refuse the Passenger to be onboard due to weight restrictions.  

6. Baggage

6.1.      No checked in baggage is allowed.

6.2.      The Passenger may take onboard one carry-on bag with a maximum weight of 5kg. Given the size of the aircraft, carry-on baggage will need to be handed over to the crew prior to or after boarding. The Passenger is solely responsible for ensuring that all personal/valuable belongings such as passports and wallets are with the Passenger before the Passenger boards.

6.3.      For safety reasons, the Passengers are prohibited from taking into the aircraft or including in his or her Baggage any flammable liquids and solids, poison, radioactive material, explosives, volatile spirits, firearms, ammunitions, compressed gases, corrosives, lighters or matches, any easily ignitable article or any offensive thing likely to cause inconvenience to Passengers or anything likely to endanger the aircraft, Passengers or crew.

Passengers and crewmembers are not permitted to carry the following articles into a security restricted area or the cabin of an aircraft:

  • Guns, firearms and other devices that discharge projectiles devices designed to cause serious injury by discharging a projectile, or capable of being mistaken for such devise, including:
    • Firearms of all types, including pistols, revolvers, rifles, shotguns
    • Toy guns, replicas and imitation firearms capable of being mistaken for real weapons
    • Component parts of firearms, (excluding telescopic sights)
    • Compressed air and CO2 guns, including pistols, pellet guns, rifles and ball bearing guns
    • Signal flare pistols and starter pistols
    • Harpoon guns and spear guns
    • Slingshots and catapults
       
  • Stunning Devices
    Devices designed specifically to stun or immobilise, including:
    • Devices for shocking, such as stun guns (e.g. teasers) and stun batons
    • Animal stunners and animal killers
    • Disabling and incapacitating chemicals, gases and sprays, such as mace, pepper or capsicum spray, tear gas, acid sprays and animal repellent sprays
       
  • Objects with sharp points or sharp edges
    Objects with a sharp point or sharp edge capable of being used to cause serious injury, including:
    • Items designed for chopping, such as axes, hatchets and cleavers
    • Ice axes and ice picks
    • Razor blades, box cutters
    • Knives with blades of more than 6 cm
    • Scissors with blades of more than 6 cm as measured from the fulcrum
    • Martial art equipment with sharp points or sharp edges
    • Swords and sabres
       
  • Workers Tools
    Tools capable of being used either to cause serious injury or to threaten the safety of aircraft, including:
    • Crowbars
    • Drills and drill bits, including cordless portable power drills
    • Tools with blades or shafts more than 6 cm. Capable of use as weapons, such as screwdrivers, chisels
    • Saws, including cordless portable power saws
    • Blowtorches
    • Bolt guns and nail guns
       
  • Blunt Instruments
    Objects capable of being used to cause serious injury when used to hit including:
    • Baseball and softball bats
    • Clubs and batons – such as billy clubs, blackjacks, and night sticks
    • Martial arts equipment
       
  • Explosive or incendiary substances or devices of being used to cause serious injury or threatening the safety of the aircraft including:
    • Ammunition
    • Blasting caps
    • Detonators & fuses
    • Replica or imitation explosive devices
    • Mines, grenades and other explosive military stores
    • Pyrotechnics, including fireworks
    • Smoke generating canisters or cartridges
    • Dynamite, gunpowder and plastic explosives
       
  • Liquid, Aerosol and Gels (LAGs)
    Liquids, aerosols and gels, unless in individual containers with a capacity not greater than 100 milliliters (or equivalent) and contained in one transparent re-sealable plastic bag of a capacity not exceeding 1 litre (or equivalent).The contents of the plastic bag shall fit comfortably and the bag shall be completely closed. The size of the plastic bag must not exceed 20cm x 20cm (8 inches x 8 inches). Exemption should be made for medications, baby milk/foods and special dietary requirements.

7. Schedule Delays, Itinerary Disruptions and Cancellations

7.1.      Qatar Executive reserves the right to effect changes to the timetables between the date of publication and the date of travel. Qatar Executive makes no guarantee pertaining to the timings stated on the published timetable to the Passenger and shall not be liable in any manner to the Passenger on account of delay resulting from any changes or variations to flight schedules, timings or cancellation of flights. Qatar Executive shall nevertheless make all endeavors to provide transportation to the Passenger with due dispatch and as close as possible to the schedules and the agreed timings as set out in the Booking Confirmation.

7.2.      Qatar Executive will not be liable for any direct or indirect costs that Passenger’s may incur as a result of any event or other factor beyond Qatar Executive’s control which necessitates a change in itinerary.

7.3.      Passengers are not entitled to any refund or compensation for any alterations to the itinerary that are caused by events beyond Qatar Executive’s control.

7.4.      If you or any member of your party wishes to cancel your booking once a booking has been confirmed and an invoice or receipt has been issued, the lead Passenger on the booking must notify Discover Qatar in writing. The cancellation charges you will be required to pay, will be calculated on the basis of the date we received the written notification and the booked departure date.

7.5.      In the event of cancellation, please contact the Discover Qatar team on +974 4144 5150 or email dqinfo@qatarairways.com.qa within a minimum of 72 hours to avoid cancellation charges. 100% Cancellation charges apply where a full 72 hours’ notice has not been received prior to arrival.

7.6.      Should your flight excursion be cancelled due to unfavorable weather conditions, an alternative date or a full refund will be provided.

8. Qatar Executive - Limitations of Liability

8.1       Baggage of whatever kind are carried at the sole risk of the Passenger.

8.2       Without prejudice to any other provision in these Terms and Conditions, the liability of Qatar Executive, in relation to any failure to perform the Carriage due to fault or omission of Qatar Executive, Discover Qatar or otherwise, shall in no event exceed an amount equal to the fare.

8.3       Qatar Executive shall not be liable (i) in the event that the aircraft is diverted to an alternative airport owing to the current travel restrictions to that airport or destination or (ii) for any onward travel to the originally planned destination or return to the original point of departure.

8.4       If and to the extent that the provisions, including the limitations of liabilities, set out therein, of the Warsaw and/or Montreal Conventions are applicable, these shall apply notwithstanding the other provisions of these Terms and Conditions.

9. Travel Insurance

9.1.      The sale of the Booking Confirmation by Discover Qatar does not include any kind of insurance.

9.2.      Passengers are solely responsible for taking out such insurance at their own expense. If a Passenger has not taken out such insurance, they accept responsibility and any costs linked to medical expenses, evacuation for health reasons, or repatriation.

10. General

10.1.    It is possible Qatar Executive may need to change the scheduled flight time subsequent to issuance of the Booking Confirmation. If the Passenger provides Discover Qatar with contact information, Discover Qatar will endeavor to notify the Passenger of any such changes. Discover Qatar shall not accept any responsibility or liability if such notice is not provided.

10.2.    Qatar Executive will not carry any animals/birds on the aircraft.

10.3.    Qatar Executive reserves the right, without notice, to cancel any flight or to substitute any aircraft for that originally scheduled or to transfer the Passenger without notice to any other aircraft or flight and all the conditions of the booking shall remain applicable to such substituted Carriage.

10.4.    Qatar Executive may arrange with any person or corporation to undertake the Carriage hereby contracted, or any part thereof or any service auxiliary thereto, including the transportation of the Passenger or his Baggage, to and from any aerodrome or taking off or landing place and any such person or corporation and his servants, agents or employees shall be entitled to the benefits of these Conditions of Carriage to the same extent as Qatar Executive.

10.5.    Notwithstanding the place of issue of the Booking Confirmation or travel documents this contract shall be governed by and construed in accordance with the laws of the State of Qatar. The parties submit to the exclusive jurisdiction of the courts of Qatar in respect of all matters arising out of or relating to this contract, its performance or subject matter.

10.6.    Passengers shall comply with the instructions of Qatar Executive, its servants or agents concerning all matters connected with or consequential to the air service and shall comply with the conditions of this booking and the terms of any notice exhibited in the aircraft. The Passenger shall be responsible for any loss or damage occasioned by non-observance of any instructions, conditions or notice.

10.7.    No agent, representative or third party have the authority to alter, modify or waive any provisions of these Conditions of Carriage.

10.8.    The rights of Qatar Executive shall not be prejudiced or restricted by any delay in exercising or failure to exercise any right and no waiver by Qatar Executive of any breach shall operate as a waiver of any other or further breach.
